THE CONCEPT OF ADMINISTRATION and ADMINISTRATIVE LAW The concept of administration is quite close to pride and prejudice. Apart from them, there is a lot of prejudice:sometimes people say that administration is very tough with citizens or is against them. People say that it is a synonym of bureaucracy. Sometimes we can read that administrative officers do not work, or do not work enough. Some people say that it is ineffective. In the common opinion, administrative law, the branch of law regulating public administration, is considered a problem or an obstacle to reach our objective or needs. It is considered quite far from daily life. What about pride? There’s a positive side of administration. It can help citizens in some way. Some examples of public administration: ● Police officers ● Questura: passport ● Municipality: it is the public administration closer to citizens ● Agenzia delle entrate: taxes ● University: a public administration, a public body. It depends on the ministry of the university. Even private university shall be linked to the ministry of the university ● Schools ● The Ministry: important in the mechanism of national administration. It takes care of national finance. ● Hospital: even for hospitals the main rule is that private ones have to follow the same rules of public ones. ● Transportation: trains, buses ● Streets: the maintenance and care of streets depend on public administration ● Firefighters ● The Army ● The air:as far as environmental issues are concerned we have one or public administration who take care of it. One of them is the ministry of environment. Air, along with land, biodiversity, are regulated by administrations. The environment is a subject very close to administration. ● Land, water, ground The study of administrative law could be quite useful to become a conscious citizen. RISE AND DEVELOPMENT OF ADMINISTRATIVE LAW Administrative law is the branch of Law regulating life into public administrations and even in the relationship between administrations and citizens. When we start a law course, we usually refer to it as a social science, having the duty to comply with social needs. The first thing to point out is that administrative law was born to create public administration of specific groups. We will find some ➔ What is administrative law? ➔ When was it born? ➔ Why is it born? ➔ How does it work? Administrative law is historically a branch of law strictly linked to the concept of state. Differently from other branches of law, it can be described as a kind of domestic law. Why differently? Could it be possible to imagine branches of law not so linked to the concept of state? Environment law is a branch of law, which was born firstly at the international level. It can be described as a very branch of domestic law. It was born into the national boundaries.
