What is Regulation?

These basic distinctions oversimplify the complex function

of law

especially regulation is not always directive, public and

 centralized

in some cases:

 rules are formulated and enforced by “self-regulatory”

 agencies ;

they are not directive and can take the form of “economic /

 market-based instruments” individuals or firms are

legally free to undertake socially undesirable activities but

must pay taxes or charges

Disagreement on definitions of the proper scope (extent

 and objective) of regulation:

deliberate the state

narrowest definition: focus on attempts by to

 influence socially valuable behaviour by establishing, monitoring and

enforcing legal rules (coercive power of the law from a traditional

legal perspective the paradigmatic form of regulation is a statute

promulgated by a sovereign legislature)

broadest definition: focus on all forms of social control, whether

 imposed by the state or other social institutions

cybernetics perspective):

“...any control system in art or nature must by definition contain a

minimum of the tree components...

standard-setting,

some capacity for to allow a distinction to be made

between more or less preferred states of the system

consequently : what is the role of law in regulation?

facilitative role law as an instrument for shaping social

 behaviour:

law as threat proscribing conduct and threatening sanctions for

 violation to deter that conduct (deterrence)

law as umpire creating and policing the boundaries of a space for free

 and secure interaction between participants / players

expressive role law institutionalising collective values

 law as threat legal prohibitions reflect strong condemnation of

 prohibited conduct

law as umpire giving expression to the community’s collective will

 concerning the appropriate conditions and the framework for the

interactions between players
