The concern of the paper is analyzing regulation of

 economic activity in Western advanced capitalist

societies.

Regulation is performed through organizations in a

 specific space, called regulatory space, shaped not

only by different national, legal, cultural

frameworks, but also by circumstances of time and

place.

Understanding the dynamics of bargaining and

 network formation btw organizations is the key.

The traditional contrast private vs public is

 overcome because of organizations.

Aim of the paper: explore the connections

 btw capitalism, culture and regulation

Institutional theories of regulation

 Economic regulation

 “Regulatory space”

 Influence of national peculiarities, time and

 place on regulation

Conclusions

 Three categories:

 Public interest theories

◦ Private interest theories

◦ Institutional theories

This paper belongs to the institutional category:

 it explains how actors are embedded in larger

institutional dynamics when it comes to

regulation.

INSTITUTIONS=formal organizations and/or

 embedded norms and procedures.

Focus on the facilitative role of law: law shapes

 the interactons among regulatory actors rather

than shaping the content of the issue to be

regulated. LAW HAS A COORDINATING FUNCTION

…under advanced capitalism is an activity

 interdependence

defined by the of powerful

organizations sharing public features,

although they may not be traditionally

defined as such:

Large firms have acquired the status of governing

◦ institutions due to their public functions: decisions

on investment, employment, output have important

implications on the allocation of resources!

No longer public-private dichotomy

 Capture of regulators has no sense here.
